Terms & Conditions
TERMS & CONDITIONS
1. About BestPremiumQuotes.com
Welcome to BestPremiumQuotes.com (the “Website”), operated by [One Touch Media LLC, doing business as Best Premium Quotes] (“we,” “us,” or “our”). We are a privately owned insurance marketing company. Our website helps you request information about Medicare Advantage and Medicare Part D plans and connects you with licensed insurance agents who can discuss plan options available in your area. There is no obligation to enroll in any plan.
We are not an insurance carrier, we are not a Medicare plan, and we are not a government agency. We are not connected with or endorsed by the U.S. government or the federal Medicare program. For official Medicare information, visit www.medicare.gov or call 1-800-MEDICARE (TTY 1-877-486-2048), 24 hours a day/7 day a week.
2. Agreement to These Terms
These Terms & Conditions (the “Agreement”) describe the rules for using the Website and the services offered through it (together, the “Service”). Please read them together with our Privacy Policy, which is part of this Agreement. By using the Website you agree to this Agreement. If you do not agree, please do not use the Website. Other services we offer may have their own terms.
Agreeing to these Terms does not give us permission to call, text, or email you for marketing. That permission is requested separately, as described in Section 6.
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Service. Minors are not permitted to use the Service.
4. What the Service Is and Is Not
When you submit a form, you are asking for information. Submitting a form does not enroll you in any plan, does not obligate you to enroll in any plan, and does not affect your current or future Medicare coverage or enrollment status.
A licensed insurance agent may contact you if you asked to be contacted. Any appointment to discuss specific plan types will be confirmed with you separately before it takes place, and you may decline or end it at any time.
We do not offer every plan available in your area. Information we provide is limited to the plans offered by the organizations we represent. Plan availability, costs, and benefits depend on where you live and can change. Please confirm details with the plan or at Medicare.gov before making a decision.
5. Medicare Disclosures
This is a solicitation of insurance.
We do not offer every plan available in your area. Currently, we represent 4 organizations which offer 2,034 products in your area. Please contact Medicare.gov, 1-800-MEDICARE (TTY 1-877-486-2048), 24 hours a day/7 day a week, or your local State Health Insurance Assistance Program (SHIP) to get information on all of your options.
Plans are insured or covered by a Medicare Advantage organization with a Medicare contract and/or a Medicare-approved Part D sponsor. Enrollment in the plan depends on the plan’s contract renewal with Medicare.
Enrollment in a plan may be limited to certain times of the year unless you qualify for a Special Enrollment Period or you are in your Medicare Initial Enrollment Period.
Medicare.gov is the official U.S. government website for Medicare, a health insurance program for people age 65 or older and for some younger people with certain disabilities.
We are not connected with or endorsed by the U.S. government or the federal Medicare program.
Participating sales agencies and licensed insurance agents may represent Medicare Advantage HMO, PPO, and PFFS organizations that have contracts with Medicare.
6. Communications and Your Consent
We contact you by phone, text message, or email for marketing only if you give your express written consent by checking an unchecked box on one of our forms. Your consent is not a condition of purchasing any goods or services. Message and data rates may apply.
You may revoke your consent or opt out at any time, by any reasonable means, including replying STOP to a text message, using the unsubscribe link in an email, using our Opt-Out Forms, emailing info@bestpremiumquotes.com, or telling a representative on a call. We will process your request within 10 business days. Opting out does not affect your Medicare coverage, benefits, or enrollment.
We do not share your personal information with any other company that markets Medicare plans unless you give separate written consent for that specific, named company. See our Privacy Policy for details.
7. Privacy
Your use of the Website is also subject to our Privacy Policy at BestPremiumQuotes.com/privacy-policy. Please do not submit your Social Security number, Medicare number, bank or card numbers, or health information through this Website. If you have questions, email info@bestpremiumquotes.com.
8. Accuracy of Information You Provide
You agree that the information you give us in our forms is accurate and truthful. We may decline, suspend, or end the Service if we reasonably believe the information is false or if you misuse the Website.
9. Submissions and Acceptable Use
You are responsible for what you submit through the Website. Do not submit or transmit anything that is defamatory, abusive, obscene, threatening, or illegal, or that infringes the rights of others or interferes with others’ use of the Website. We may remove submissions we consider inappropriate and may limit access for anyone who violates this Agreement. We will disclose information about your use of the Website only as required by law, including to law enforcement or in response to valid legal requests.
10. Content and Linking
The content on this Website is for general informational purposes only and is not insurance, legal, tax, or medical advice. We try to keep it accurate and current, but errors may appear and some information may be out of date. Please verify anything important to your decision with the plan, a licensed agent, or Medicare.gov.
We are not responsible for, and do not guarantee, the products or services of advertisers or other sites we link to. A link to another site is not an endorsement of that site or of anything it offers.
You may link to our homepage as long as the link does not state or imply any affiliation, connection, sponsorship, or approval by us, and does not imply any connection with Medicare or the U.S. government. We do not permit framing or inline linking to any part of the Website.
11. Intellectual Property
The materials on this Website belong to us or our licensors and are protected by copyright, trademark, and other laws. You may display and print materials for your personal, non-commercial use. You may not otherwise copy, modify, or distribute them without written permission. Send permission requests to info@bestpremiumquotes.com. Our name, logos, and other marks are our trademarks, and you may not use them without our written permission.
12. Disclaimer of Warranties
To the fullest extent allowed by law, the Website is provided “as is” and “as available.” We do not warrant that the Website will be error-free, uninterrupted, or free of viruses, or that the information on it is complete, accurate, or timely. Nothing in this Agreement limits any right you have under Medicare rules or under your plan.
13. Limitation of Liability
To the fullest extent allowed by law, we, our affiliates, agents, and licensors are not liable for indirect, incidental, special, or consequential damages arising from your use of the Website, whatever the legal theory. Some states do not allow certain exclusions or limits, so parts of this section may not apply to you. Where limits are not allowed, our liability is limited to the extent permitted by your state’s law.
14. Indemnification
You agree to defend and hold us harmless from claims, losses, and reasonable attorney fees that result from your breach of this Agreement. This section continues after the Agreement ends.
15. Termination
We may end or limit your use of the Website if you do not follow this Agreement. You may stop using the Website at any time.
16. Fair Treatment
We do not deny, limit, or treat anyone differently in connection with the Service based on race, color, national origin, sex, age, disability, religion, or health status.
17. Severability
If a court finds part of this Agreement unenforceable, the rest stays in effect.
18. Notices
We may send notices to you by email or regular mail, or by posting a notice on the Website.
19. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date. For material changes, we will post a prominent notice on the Website. Your continued use of the Website after changes are posted means you accept them, but changes will never give us permission to contact you for marketing. That permission is always requested separately.
20. No Resale
Unless we give you written permission, you may not reproduce, copy, sell, resell, or otherwise use any part of the Service or access to it for commercial purposes.
21. Violations and Feedback
Report violations of this Agreement, or send questions, comments, or corrections, to info@bestpremiumquotes.com.
INTERNAL NOTES (not for publication)
What was changed and why
- “Provides you no-obligation quotes for your Medicare Advantage plans” was replaced. It suggests you sell or price plans yourselves. The new wording says you connect people with licensed agents, which matches the TPMO role. The no-obligation statement stays.
- Added: Medicare non-affiliation statement, “solicitation of insurance,” the TPMO disclaimer with your counts, 1-800-MEDICARE with the TTY number, and the statement that you do not offer every plan.
- Added: Section 4 and Section 6 saying that submitting a form does not enroll anyone, that any appointment on specific plan types is confirmed separately, and that consent to marketing is given only through an unchecked box. This keeps the Terms from acting as hidden consent.
- Added: per-company consent for sharing data with other marketing companies (CMS TPMO rule), opt-out methods, and the 10-business-day timing.
- Changed: “your application” to “our forms.” You do not take enrollment applications on this page, and the word could imply you do.
- Changed: “may update without notice” and “any use signifies consent” to posted notice for material changes, and added that updates never grant marketing consent.
- Changed: “deny service with or without cause, in our sole discretion” to reasonable grounds, and added a fair-treatment statement. Review this with counsel.
- Narrowed: indemnification now covers only your breach of the Agreement, and the “amount you paid” liability cap was replaced with the extent allowed by law. The audience includes many older adults, and very one-sided terms invite complaints.
- Removed: duplicate “exclusions” text, repeated warranty language, and the filler wording about archives and news stories.
Items you must confirm before publishing
- Legal entity name, phone, mailing address, and the Privacy Policy URL.
- A governing-law and dispute clause is missing from the original and from this version. Ask your attorney whether you want one and which state it should name.
- That the counts in Section 5 (4 organizations, 2,034 products) stay accurate for each visitor’s area.
- Whether your carriers require review or approval of this page.
CMS does not publish standard Terms & Conditions. The CMS-based parts are the TPMO disclaimer, the non-affiliation and solicitation statements, the limits on sharing data, and the rule against misleading use of the Medicare name. Other parts reflect FCC (TCPA), FTC, and state law and good practice. This is not legal advice. Have an attorney and your compliance officer review it before it goes live.
